Commissioner Alan Kirkland has outlined a strategic shift towards an "outcome-based" approach, prioritizing specific goals over rigid, prescriptive rules. This move signals a deliberate effort to navigate the often-conflicting demands of financial innovation, consumer protection, and market stability – a complex challenge dubbed the "regulatory trilemma" by Kirkland.

Speaking at Blockchain APAC's Policy Week, Kirkland emphasized the need to cultivate trust in the burgeoning realm of cryptocurrencies and decentralized finance (DeFi). He acknowledged ASIC's ongoing commitment to fostering responsible financial innovation, having provided informal guidance to over 900 entities since 2016.

The focus on desired outcomes, according to Kirkland, translates to "a clear set of rules" that safeguard market integrity while mitigating risks for consumers and investors. He envisions a regulatory framework complemented by robust enforcement mechanisms to ensure compliance. ASIC has also witnessed a surge in proposals for tokenizing traditional financial products and real-world assets. Kirkland anticipates that some forms of tokenization will fall under existing regulations, while others might require oversight under the government's proposed digital asset platform.

This news comes on the heels of a recent court ruling that declared Finder, an Australian crypto firm, compliant with regulations pertaining to its "Earn" product. Additionally, in October 2023, the Department of the Treasury released a consultation paper proposing mandatory financial services licenses for crypto exchanges operating within Australia. These licenses would be issued by ASIC, with a threshold of AU$5 million in total holdings or AU$1,500 per individual investor triggering the licensing requirement.

The Treasury Department's proposal has garnered mixed reactions from Australian crypto exchanges, highlighting the complexity of crafting regulations in this nascent space. The consultation paper itself acknowledges this and serves as a call for industry feedback to ensure a balanced and effective regulatory framework for Australia's digital asset future.
