The center, which operates under its own legal system based on English common law principles, has announced the passage of a new Digital Assets Law and a revamped Security Law, complemented by amendments to existing legislation.

This legislative overhaul seeks to solidify the DIFC's position as a forward-thinking jurisdiction, adeptly navigating the intricacies of international trade and financial markets while providing legal certainty and clarity for investors and users of digital assets. Jacques Visser, the esteemed Chief Legal Officer of the DIFC Authority, heralded this development as a trailblazing achievement, stating:

"We consider this legislation to be groundbreaking as the first legislative enactment to comprehensively set out the legal characteristics of digital assets as a matter of property law."

The Digital Assets Law, a meticulously crafted seven-page document accompanied by appendices, serves as the cornerstone of this legislative endeavor. The DIFC's financial performance in 2023 underscores the success of its strategic initiatives, with a remarkable 45% increase in net profit, reaching an impressive $203 million. Additionally, the center witnessed a 34% surge in new registrations, attracting a diverse array of businesses, including an influx of hedge funds, as well as companies from Europe and the United States.

While the DIFC's Digital Assets Law is hailed as a pioneering endeavor, it is not the first jurisdiction to grapple with the legal implications of digital assets as property. In the previous year, courts in China, Singapore, and Hong Kong issued landmark rulings that recognized digital assets as a form of property, further contributing to the global discourse on this emerging asset class.
