Elon Musk has withdrawn his lawsuit against OpenAI, according to two court filings from June 11.

One filing indicates that Musk, the plaintiff, filed a notice of entry of dismissal and proof of service. The other filing confirms the case's dismissal without prejudice, allowing Musk the option to refile in the future.

On the same day, CNBC reported that the Superior Court of California, County of San Francisco, had planned a hearing for June 12 before Musk dropped the case. This hearing would have addressed OpenAI and the associated defendants' request to dismiss the lawsuit.

The Lawsuit

Musk filed his lawsuit on February 29 against OpenAI, its co-founder and CEO Sam Altman, and several other members. He accused OpenAI of breach of contract and unfair competition, claiming the company now develops AI for profit rather than for the benefit of humanity, has adopted a closed-source model, and essentially operates as a subsidiary of Microsoft, its funding source and partner.

In March, OpenAI issued a public statement asserting that Musk had acknowledged the need for a for-profit model and that it intended to request the court dismiss the case.

Musk co-founded OpenAI and served on its board until 2018. He currently leads a competing firm, xAI, which promotes pro-humanity goals and secured $6 billion in funding in May, reaching a valuation of $24 billion.
