Estonia, once a haven for cryptocurrency businesses, is tightening its grip on the industry. A recently approved government bill proposes stricter regulations for crypto service providers, aiming to bring the country in line with the European Union's Markets in Crypto-Assets (MiCA) framework. This move signifies a significant shift from Estonia's earlier embrace of crypto firms, marked by a wave of crackdowns and stricter AML (Anti-Money Laundering) requirements in recent years.

Currently, crypto businesses in Estonia operate under the supervision of the Financial Intelligence Unit (FIU). The new bill, however, proposes a transfer of oversight to the more robust Financial Supervision Authority (FSA) starting in 2025. This change signifies a commitment to stricter licensing procedures and ongoing monitoring of crypto service providers. The financial implications are also noteworthy. While AML violations were previously capped at a €40,000 fine, the new legislation empowers the FSA to impose penalties of up to €5 million – a significant deterrent for non-compliant firms.

The proposed bill isn't solely focused on tightening the belt. It also seeks to streamline regulations for companies raising capital through traditional means like stocks or bonds. The current threshold requiring a detailed prospectus (a lengthy and expensive process) for offerings exceeding €5 million will be raised to €8 million. This change offers a sigh of relief for businesses seeking more flexibility in raising funds.

Estonia's relationship with the crypto world has been a rollercoaster ride. In 2017, it established itself as a crypto-friendly nation, offering easy registration and favorable laws for crypto firms. However, this enthusiasm was tempered in 2020 following a large-scale corruption scandal, prompting a crackdown on crypto businesses. Over 500 FIU-issued crypto licenses were revoked that year, and stricter AML rules were implemented in 2021, leading to the closure of nearly 400 virtual asset providers.

The proposed bill reflects a renewed attempt to strike a balance between fostering innovation and ensuring financial stability within the crypto ecosystem. By adopting a stricter oversight approach, Estonia aims to deter illegal activities while simultaneously streamlining regulations for legitimate businesses.
