In a bold move, Travis Hill, the Vice Chairman of the Federal Deposit Insurance Corporation (FDIC), has taken aim at the United States Securities and Exchange Commission's (SEC) controversial SAB 121, while advocating for a more transparent regulatory approach within his own agency. Speaking at the Mercatus Center at George Mason University on March 11, Hill's remarks echoed a growing sentiment within the financial sector – the need for regulatory clarity amidst the rapidly evolving landscape of blockchain and distributed ledger technology.

Hill's critique of the FDIC's existing regulatory framework was unequivocal, asserting that the lack of clarity has "contributed to a general public perception that the FDIC is closed for business if institutions are interested in anything related to blockchain or distributed ledger technology." Acknowledging the challenges faced by regulators in keeping pace with technological advancements, Hill nonetheless emphasized the importance of providing as much clarity as possible regarding what is permissible and what constitutes safe and sound practices.

But Hill's scrutiny extended beyond the FDIC's domain, as he trained his sights on the SEC's contentious SAB 121 accounting bulletin. This bulletin, which would require banks to list digital assets on their balance sheets, drew Hill's ire for its departure from traditional custody accounting practices. "This treatment sharply departs from how custodians account for all other assets held in custody, which are generally held off-balance sheet and treated as the property of the customer, not the custodian," he explained, highlighting the potential challenges this poses for banks seeking to engage in digital asset custody at scale.

Hill's remarks come at a time when SAB 121 is facing mounting opposition, with the House Financial Services Committee recently voting in favor of a resolution that could see the bulletin overturned if approved by the full House of Representatives.

The FDIC itself has not been immune to criticism regarding its stance on cryptocurrencies. Last year, the agency claimed that digital assets presented "novel and complex risks" in its 2023 Risk Review report. Furthermore, the FDIC's approval of a modernized advertising rule in December 2022, aimed at curbing "misrepresentations" and "false advertising" regarding deposit insurance coverage, drew praise from organizations like Better Markets, which accused crypto firms like Gemini Earn, FTX US, and Voyager Digital of misleading investors about the extent of their FDIC insurance coverage.

As the crypto landscape continues to evolve at a breakneck pace, Hill's call for regulatory clarity resonates as a necessary step towards fostering innovation while maintaining financial stability and consumer protection.
