Hong Kong's financial overseer, the Securities and Futures Commission (SFC), has emphasized the importance of crypto companies adhering to regulations. The SFC has underlined the significance of virtual asset trading platforms (VATPs) registering before the impending deadline. The commission has set June 1 as the cutoff date for platforms operating under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO). It has alerted investors and stakeholders to the risks associated with failing to register by the deadline.

Consequences of Non-Registration

In a recent announcement on May 28, the regulator highlighted that breaching the AMLO constitutes a criminal offense, leading to potential actions by the SFC against violators. The SFC stressed that all businesses in Hong Kong must either be registered or considered "deemed-to-be-licensed" under the law.

Compliance and Warnings

Investors are strongly advised to engage only with SFC-licensed firms and verify their status on the official website. For firms deemed to be licensed, the SFC cautioned that although they are not fully licensed yet, they have been operating within the legal framework and are working to enhance their policies and structures. Deemed-to-be-licensed VATPs are required to adhere to all guidelines and are prohibited from onboarding new retail clients until compliance is achieved. Additionally, these firms must prevent mainland Chinese residents from accessing their services as per the regulations.
