Disclosed within the submission was news that Gurbir Grewal, the Director of the Division of Enforcement, greenlit a Formal Order of Investigation related to 'Ethereum 2.0' in March 2023. This edict provided SEC personnel with the authority to scrutinize and send out subpoenas to individuals and entities engaged in Ethereum transactions. This decree was instigated on the back of data suggesting likely offerings and sales of certain securities, including ETH, dating as far back as 2018, sans a registration statement in force and without exemption.

In the wake of this, the SEC has beckoned numerous investors and bodies holding stakes in Ethereum, including Consensys, to furnish pertinent information. This divulgence emerged shortly after Consensys initiated legal action against the SEC on April 25, contending that the SEC's endeavor to label Ethereum as a security exceeded its prescribed regulatory scope, and potentially posed adverse repercussions on innovation and Ethereum's decentralized realm.

The Regulatory Conundrum Enveloping Ethereum

The quandary of how Ethereum ought to be categorized has persistently haunted the SEC. Gensler's stances on Ethereum have witnessed a discernible evolution. In a discourse at the Massachusetts Institute of Technology in 2018, Gensler appeared to suggest that ETH did not align with the definition of a security.

Nevertheless, Gensler's stance seems to have morphed, especially in light of Ethereum's migration towards a proof-of-stake consensus mechanism. Despite these developments, he has refrained from issuing a definitive pronouncement on Ethereum's classification despite entreaties from sundry parties, including members of Congress.

Even as Gensler remains reticent on the topic, advocates within the crypto community have alluded to pronouncements from erstwhile SEC figures like Bill Hinman and legal submissions from supervisory entities such as the Commodities Futures Trading Commission to counter the notion of Ethereum being perceived as a security.
