LBank, a prominent centralized cryptocurrency exchange established in 2015 and based in the British Virgin Islands, has come under fire from Japan’s Financial Services Agency (FSA). The regulatory watchdog issued a stern warning to LBank for allegedly conducting cryptocurrency transactions without proper registration, a serious breach of Japan’s stringent financial laws.

According to reports from Coinpost, the FSA highlighted significant concerns regarding LBank’s operations, including transactions facilitated with Japanese residents via the internet. The exchange was accused of operating with an “unknown address” and “unknown representative,” which raised red flags about transparency and accountability.

Currently ranked #55 in terms of 24-hour spot trading volume by CoinGecko, LBank supports an extensive array of 671 coins and 814 trading pairs. Despite its global reach and market presence, the exchange’s regulatory missteps have drawn regulatory scrutiny in Japan.

This warning from the FSA comes shortly after LBank hosted a high-profile web3 investor meetup in Dubai, underscoring a disconnect between its international outreach efforts and compliance with local regulations. The incident echoes previous actions by the FSA, which in March 2023 issued warnings to other cryptocurrency exchanges like Bybit, MEXC, Bitget, and Bitforex for similar violations related to serving Japanese residents without proper registration.

In contrast to Japan’s structured regulatory approach, the United States’ regulatory landscape remains fragmented and in flux. In 2022, President Joe Biden’s administration initiated steps to assess the risks and benefits of cryptocurrencies, leading to a roadmap aimed at enhancing regulatory enforcement. Recently, however, the White House vetoed a bill that sought to repeal a contentious bulletin from the U.S. Securities and Exchange Commission (SEC), impacting custodial services for crypto assets.

The SEC has been actively treating many cryptocurrencies as securities and has pursued legal actions against non-compliant crypto businesses. A notable case was the 2023 court ruling concerning Ripple’s XRP, which determined its status as securities when sold to institutions but not on exchanges—a nuanced outcome impacting the crypto sector.
