Nigeria's Securities and Exchange Commission (SEC) has unveiled a proposed amendment to the rules governing platforms offering crypto services, suggesting a substantial increase in the registration fee for crypto exchanges. The amendment proposes raising the fee from 30 million naira ($18,620) to a staggering 150 million naira ($93,000), marking a significant 400% surge.

The SEC justified the proposed changes as an effort to provide greater clarity and incorporate valuable insights from industry stakeholders, particularly in light of recent engagements with the Central Bank of Nigeria (CBN). The Nigerian SEC initially issued comprehensive rules and guidelines for all crypto and digital asset service providers in May 2022, but on Friday, March 15, 2024, it put forth this amendment, signaling its commitment to adapting to the rapidly evolving crypto landscape.

Under the updated guidelines, digital asset exchanges, digital asset offering platforms, and digital asset custodians will face increased fees across multiple aspects of their operations. The application fee has been tripled from 100,000 naira ($62) to 300,000 naira ($186), while the processing fee has skyrocketed from 300,000 naira ($186) to 1 million naira ($620).

The SEC stated that these amendments aim to enhance clarity and incorporate input from industry stakeholders, reflecting insights gained from recent discussions with the Central Bank of Nigeria. However, the proposed 500 million naira ($310,343) paid-up capital requirement has drawn criticism from some quarters, with concerns that such a high barrier to entry could primarily favor foreign firms and disadvantage local entities.

Nigeria has emerged as a global crypto hotspot in recent years, cementing its position as one of the fastest-growing crypto economies worldwide. In 2023, the country ranked as the second-biggest economy in terms of crypto adoption, underscoring the increasing prominence of digital assets within its financial landscape. Additionally, in August 2022, Nigeria was named the most "crypto-obsessed" country globally based on the number of Google searches for "cryptocurrency" or "buy crypto."

The proposed fee hike comes amid significant economic challenges faced by Nigeria. In June 2023, the country abandoned its years-long currency peg and allowed the naira to trade freely, subsequently facing record-high inflation rates. According to data from the National Bureau of Statistics, Nigeria's consumer inflation rose for the 13th straight month in January 2024, reaching nearly 30%.

The SEC's move to amend the rules governing crypto service providers is a reflection of the rapidly evolving crypto landscape and the increasing demand for regulatory clarity within the industry. By seeking input from industry stakeholders and engaging with the Central Bank of Nigeria, the SEC aims to strike a balance between fostering innovation and mitigating potential risks associated with the crypto ecosystem.
