In the wake of Binance's announcement to restrict access to "unauthorized" stablecoins in Europe by the end of the month, Tether CEO Paolo Ardoino has voiced significant concerns about the European Union's Markets in Crypto-Assets Regulation (MiCA) and its potential repercussions for stablecoins.

Ardoino highlighted Tether's active involvement in regulatory consultations over recent months. "Tether has been actively involved in regulatory technical standards consultations over the past months and remains concerned that MiCA contains several problematic requirements," he told The Block. "These requirements could not only render the job of a stablecoin issuer extremely complex but also make EU-licensed stablecoins extremely vulnerable and riskier to operate. As with any regulatory framework of this scale, further discussions on the technical implementation standards are crucial to providing clarity to the market over certain provisions."

On Monday, Binance, the world's largest cryptocurrency exchange by trading volume, announced that starting June 30, it would limit access to "unauthorized" stablecoins for European users, although it did not specify whether Tether's USDT, the largest stablecoin by circulation, would be affected. Binance CEO Richard Teng clarified in an X post that "Binance won't delist any unauthorized stablecoins on spot but will limit their availability for [European] users only on certain products," with updates on regulated stablecoins to be provided soon.

Other exchanges like OKX and Kraken are also grappling with MiCA's implications. OKX announced in March that it would stop supporting USDT trading pairs in Europe, while Kraken is actively reviewing whether to delist USDT, according to recent reports.

Binance acknowledged the regulatory challenges ahead, noting in a blog post that "there are few regulated stablecoins with limited liquidity that may not be sufficient to support sudden demand across the industry."

Tether's CEO, Paolo Ardoino, has been vocal about the need for stablecoins to maintain robust capital reserves. In an April post, Ardoino stressed the risks associated with uninsured cash deposits, citing recent banking failures as cautionary examples. "Uninsured cash deposits are not a good idea. We should learn from what happened with Silicon Valley Bank and another major stablecoin in the US. If a bank goes bankrupt, uninsured cash goes into bankruptcy. Stablecoins should be able to keep 100% of reserves in treasury bills, rather than exposing themselves to bank failures keeping big chunk of reserves in uninsured cash deposits. In case of bank failure, securities return back to the legitimate owner."

An attestation published last month revealed that the majority of Tether's approximately $110 billion in circulation at the end of the first quarter was backed by U.S. Treasurys.

Ardoino also mentioned that Tether has been engaging extensively with European exchanges regarding the impending MiCA regulations. "Tether has engaged extensively with its exchange counterparties in Europe regarding the requirements, including those pertaining to the ongoing listing of USDt and other Tether tokens, and the interpretation of key regulatory provisions," he said.

While Tether is optimistic about MiCA's implementation, Ardoino emphasized the need for balanced regulatory policies that protect consumers and foster industry growth. Under MiCA, stablecoin issuers must obtain an electronic money institution (EMI) license to operate in the EU, a move seen as beneficial for user protection but contingent on rigorous regulatory enforcement.

Jon Egilsson, co-founder of Monerium, the first company to receive an EMI license to issue a stablecoin in Europe, remarked, "The EMI license is mostly for consumer protection and to ensure singleness of money. But it will not work unless regulators enforce the law, and the EU regulators have failed so far."

As the crypto industry braces for MiCA's impact, the ongoing dialogue between regulators and industry stakeholders like Tether and Binance will be crucial in shaping the future landscape of stablecoins in Europe.
