In a statement, the Seychelles-registered brokerage firm was instructed to pay $1,179,008 in disgorgement. However, Falcon Labs was granted a reduced civil monetary penalty of $589,504 in recognition of its significant cooperation with the CFTC's Division of Enforcement.

Commission Warns Unregistered Intermediaries

Ian McGinley, the CFTC's director of enforcement, commended the penalty imposed on Falcon Labs, emphasizing its role in clarifying the commission's stance on unregistered digital asset brokers.

"The CFTC is escalating its efforts by, for the first time, penalizing an intermediary that unlawfully facilitated access to those exchanges. Today's action underscores that the CFTC will not hesitate to penalize any entities — exchanges or intermediaries — providing customers access to digital asset products and services requiring registration but failing to register appropriately."
