The idealized version of privacy technology often involves a company defying legal requests and emerging victorious, but this is unrealistic. If Proton were to ignore legal demands, it would face severe legal consequences that could jeopardize its existence. This scenario would be detrimental not only to Proton but also to its users and the broader privacy community.

Proton’s compliance with nearly 6,000 legal requests in 2023 demonstrates the practical challenges they face. While some argue that the activist’s operational security (opsec) was to blame, this perspective doesn’t address the core issue: improving privacy tools to prevent such breaches. Suggestions include using VPNs, Tor, and cryptocurrencies for added security, but these measures require user diligence and can still leave gaps.

To further enhance privacy, decentralizing parts of the system could be a solution. Decentralized networks can reduce the amount of data a company processes and offer more robust privacy protections. Technologies like onion routing and blockchain-secured networks could protect user IPs and metadata more effectively. Although fully decentralized email services might be impractical, similar approaches could benefit other communication tools, offering enhanced security for at-risk individuals.

Ultimately, companies will continue to comply with legal requests, as this is a necessity. However, integrating decentralized technologies could provide additional layers of protection, benefiting users who require heightened security. Proton and other privacy-focused companies have the opportunity to adopt these solutions to better serve and protect their users in an increasingly surveilled world.
