Elon Musk has withdrawn his lawsuit against OpenAI, as confirmed by court filings on June 11. One filing indicated that Musk, as the plaintiff, submitted a notice of dismissal and proof of service. Another filing noted that the case was dismissed without prejudice, allowing Musk the option to refile it in the future.

According to CNBC's report on the same day, the Superior Court of California of the County of San Francisco was scheduled to hold a hearing on June 12 regarding OpenAI and related defendants' motion to dismiss the lawsuit. However, Musk dropped the case before the hearing took place.

Background of the lawsuit:

Musk initiated the lawsuit against OpenAI, its co-founder and CEO Sam Altman, and several other members of the company on February 29. The lawsuit included allegations of breach of contract and unfair competition. Musk claimed that OpenAI had shifted its focus to developing AI for profit rather than for the benefit of humanity, adopted a closed-source model, and effectively became a subsidiary of its funding source and partner, Microsoft.

In March, OpenAI publicly stated that Musk had acknowledged the necessity of transitioning to a for-profit model. The company indicated its intention to request the court to dismiss the case at that time.

Musk was involved in founding OpenAI and served on its board until 2018. He now heads xAI, a competing firm that asserts pro-humanity objectives. xAI recently secured $6 billion in funding in May, boosting its valuation to $24 billion.
