Elon Musk has opted to withdraw his lawsuit against OpenAI and its CEO Sam Altman, just a day before a federal judge was scheduled to make a decision regarding the case's progression.

Musk's legal team filed a request to drop the breach of contract lawsuit without prejudice in the San Francisco Superior Court on June 11. This move allows Musk to potentially refile the lawsuit in the future.

The lawsuit, initiated on Feb. 29, 2024, alleged that OpenAI had strayed from its original mission of developing AI for the betterment of humanity, instead focusing on profit-oriented endeavors. Musk specifically cited OpenAI's collaborations with Microsoft and the closed-source launch of ChatGPT-4 as deviations from its founding principles.

Despite Musk's complaints and calls for OpenAI to return to its open-source roots, the lawsuit has now been withdrawn without an accompanying statement from Musk regarding the decision.

One of Musk's primary concerns revolved around OpenAI's partnership with Apple to integrate ChatGPT into Apple devices. Musk labeled this move as an "unacceptable security violation," expressing apprehension about entrusting user privacy and security to a third-party entity like OpenAI. However, Apple reassured users that their data privacy would be protected, emphasizing that user IP addresses would remain obscured, and OpenAI would not retain data requests.

Meanwhile, Musk's own venture into the AI chatbot arena with Grok, developed by xAI, reflects his ongoing interest in AI development. Grok secured significant funding in late May, signaling Musk's continued involvement in the AI space despite the withdrawal of the lawsuit against OpenAI.
