Chairman Patrick McHenry of the House Financial Services Committee has announced plans for the potential House floor vote on new legislation aimed at providing clearer regulatory frameworks for the digital assets industry by the end of May. The proposed Financial Innovation and Technology for the 21st Century (FIT21) Act seeks to address longstanding issues surrounding market oversight and consumer protection in the crypto space.

McHenry emphasized the necessity of this legislation, citing the regulatory uncertainty that has hindered innovation and left consumers vulnerable within the U.S. digital asset ecosystem. The consideration process for FIT21 will afford the bill the attention it warrants, aiming to alleviate concerns and foster a more conducive environment for industry growth and development.

Scheduled for consideration during the week of May 20, the FIT21 Act will undergo assessment by the House Committee on Rules, responsible for determining the structure of debate and potential amendments. With a composition of nine Republicans and four Democrats, the committee will play a pivotal role in determining the bill's progression to a floor vote by the end of May, after which it must navigate through the Senate and presidential approval.

One of the key provisions of FIT21 is the clear delineation of regulatory jurisdiction between the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC). By assigning the CFTC oversight over crypto commodities and the SEC authority over crypto offered within investment contracts, the legislation aims to establish distinct regulatory boundaries and provide clarity for industry participants.

Moreover, FIT21 seeks to facilitate secondary market trading of crypto commodities initially offered within an investment contract. This provision, along with requirements for company registration, customer disclosure, asset safeguarding, and operational standards, aims to enhance transparency and accountability within the crypto industry. Introduced by several prominent representatives in July 2023, the bill represents a concerted effort to address regulatory ambiguities and foster a more robust and regulated environment for digital assets.
