The Chair of the United States Securities and Exchange Commission (SEC), Gary Gensler, criticized certain cryptocurrency companies for avoiding registration requirements to escape regulatory scrutiny. Speaking at Columbia Law School on March 22, Gensler strongly condemned how some crypto firms handle regulatory compliance. In his speech, he stressed the importance of mandatory disclosure, quoting Supreme Court Justice Louis Brandeis who famously said, “Sunlight is said to be the best of disinfectants.”

Gensler expressed concerns about the cryptocurrency market, particularly Bitcoin, which reached a record high in March. He described Bitcoin as a highly speculative and volatile asset, cautioning investors to be careful. He highlighted that some entities in the crypto securities markets are trying to evade registration requirements, thus avoiding mandatory disclosure obligations.

Gensler emphasized the need for transparency in the crypto markets, suggesting that they could benefit from more openness.

The SEC has been actively pursuing enforcement actions against major players in the crypto industry such as Kraken, Binance, Ripple, and Coinbase.
