The deadline for the SEC to decide on VanEck's application is set for May 23. The following day, the SEC will issue its verdict on the proposal submitted jointly by ARK Invest, led by Cathie Wood, and ETF issuer 21Shares. Additionally, other prominent financial firms such as BlackRock, Fidelity, Bitwise, Galaxy Digital, Franklin Templeton, and Hashdex are also in the race to launch a spot Ethereum ETF.

Industry experts predict that the SEC is likely to reject these spot Ethereum ETF applications. This expectation stems from the apparent lack of meaningful dialogue between the agency and the ETF issuers. While a rejection seems almost certain, the official rationale behind the decision remains speculative. Bitwise's Chief Investment Officer, Matt Hougan, suggested that the rejection could be due to inadequate data. Conversely, some legal analysts, including Scott Johnsson, speculate that the SEC might classify the underlying asset as an unregistered security in its forthcoming order.

Adding to the market's unease, Ethereum recently hit a new yearly low against Bitcoin, trading at 0.044 BTC on May 16. Although it has since rebounded by approximately 6%, the sentiment remains bearish ahead of the impending ETF decision. Currently, Ethereum is trading at $3,104, according to data from CoinGecko.
